Some of the most dangerous car accidents involve large trucks. One Louisiana man is filing suit against multiple parties after a motor vehicle accident on Interstate 59.
The man alleges that he was driving his car when the driver of a tractor-trailer rear-ended him, causing him to be thrown around the car. The man claims that he suffered numerous physical, mental and emotional injuries, and that they continue to plague him.
When a lawsuit is filed after a truck accident, the plaintiff may name more than just the truck driver in the suit. In the man’s suit filed in late April of this year, he names the driver, an insurance company and various trucking companies. The man alleges that the defendants were negligent in allowing an unqualified or reckless driver to drive and that they failed to screen and test the driver to evaluate him. The suit alleges that the driver was fatigued and was experiencing sleep deprivation at the time of the accident and that he should not have been permitted to operate the truck.
When an accident occurs, you can file a personal injury lawsuit against all responsible parties and possibly recover damages to help you with your medical bills, lost wages, pain and suffering and other costs. Courts will look at the facts of the case and determine who is at fault for the accident. In some cases, the fault will be apportioned, meaning that multiple parties will have a percentage assigned to them, showing how much of the accident was their fault. These percentages may affect the amount of damages they will be required to pay. In any case, financial recovery could potentially help you move beyond an accident.
