Drunk driver arrested for vehicular homicide in Ascension Parish

Driving securely should always be our topmost concern. When we drive a motor vehicle, be it single or with a commuter, it's important we understand the essentials of safe driving and follow them dutifully each and every time we are on the road. Wearing a seat belt, avoiding driving after drinking or if feeling drowsy and being careful while changing lanes can be some of the best practices to follow.

Recently, Louisiana State Police arrested a drunk driver after a fatal crash in Ascension Parish that claimed the life of a pedestrian. The incident happened on LA Hwy 44 north of LA Hwy 935, just after 2:30 a.m. Monday, and the preliminary investigation showed that the 32-year-old of Gonzales was dead at the scene. According to police, the driver, also of Gonzales, was driving a 2013 Volkswagen Beetle eastbound on LA Hwy 44 when she hit the victim who was crossing the roadway. She could not get around the victim.

The driver was restrained at the time of the accident and didn't suffer any injury. However, her breathalyzer test recorded she was beyond the permissible limit. She was then arrested with charge vehicular homicide and taken to the Ascension Parish jail. The Louisiana State Police is investigating further into the case.

If you or any of your loved one are affected in a crash caused by drunk driving, you may file a civil lawsuit against the negligent driver and claim damages. You may also file a wrongful death lawsuit in case of death of the victim in such accidents. However, you can pursue these legal avenues subject to the ability to prove it in the court of law. You may have to gather evidences such as police investigation reports, witness reports, expert testimonies and other items to establish that the BAC level of the accused was beyond legal limit for safe driving. You may have to demonstrate that the driver at fault didn't take reasonable care to safeguard others on road from probable risks.

In such circumstances, it's sensible to take help from an experienced legal professional who will examine the case from all aspects and make sure that your legal rights are safeguarded. A professional can help you in collecting evidence, interviewing witnesses, consulting experts, researching the law and dealing with insurance providers and defendant's counsel.
